A Word of caution: Not everybody is eligible to file for a fast divorce in the Dominican Republic. Therefore, please be very careful! Don't be fooled by certain online services, unscrupulous law firms, travel agencies, unethical attorneys, paralegal services or phantom Internet companies that promise you a Dominican divorce without traveling, by proxy, by mail, contested or without the consent or knowledge of your spouse.
Dominican Divorce Law 142 allows foreign citizens to file for their fast divorce by mutual consent without living or residing in the Dominican Republic. However, it requires that both spouses agree to file for divorce; both spouses sign a marital separation agreement before a Notary; get the documents apostilled or authenticated by the corresponding local authorities in their jurisdiction; and at least one of them appears in person before the judge in the Dominican court on the day of the divorce hearing.
So, please be very careful! It does not matter if you are dealing with a law firm or an attorney alleging several years of experience in filing Dominican divorces. If there is no due process pursuant Dominican Divorce Law 142 during the entire divorce proceeding, you might end up with a false, fraudulent, void or voidable divorce. Always keep in mind that:
• The Dominican Fast divorce for foreign citizens (not living or residing in the Dominican Republic)is a divorce by mutual consent only. Therefore, there is no plaintiff or defendant, just petitioning parties. And, both parties must aware and consent to the divorce at all time;
• No Dominican attorney or third party, should sign for you and/or your spouse, the initial "Marital Separation/Settlement Agreement" that it is required to file for a fast divorce in the Dominican Republic, no matter if you grant a power of attorney. Such initial document should be only signed by you and your spouse, before a local Notary Public (or corresponding authority) in your jurisdiction or in the jurisdiction of the non-appearing party to the hearing;
• foreign citizens not living or residing in the Dominican Republic, cannot file for a regular mutual consent divorce or for a contested divorce (only one party will agree to the divorce) in Dominican Republic. US and Foreign citizens living outside the Dominican Republic, can only file for a Fast Divorce by Mutual Consent pursuant Divorce Law 142 requirements. For more details click here
• If you and/or your spouse lives in a country that is member country or non-member country to the Apostille Section of the Hague Convention you shall not authenticate the necessary documents before the closest Dominican Consulate (as mentioned in several online websites), but just obtaining the Apostille Certificate from the correspondent local authority, for the public authority (Notary Public, county clerk, etc.) that has notarized your signatures on the initial documents, required to file for your fast divorce in the Dominican Republic. In fact since end of August 2009, Dominican Republic is a non-member party to the Apostille Section of the Hague Convention, therefore the authentication of certain documents going to the Dominican Courts and issued by foreign authorities in countries that are also member of the same convention, by the Dominican Consulate is no longer need.
